Guest Waiver and Release of Liability

General Safety and Wildlife Conservation Rules

The Participant agrees to adhere to all rules, signs, and instructions provided by Itsinya staff or posted on the Property. Specifically:

• Adherence to Paths: The Participant agrees to strictly adhere to predefined and established paths for all nature walks. These paths have been designed for the Participant's safety and to be as least intrusive to the natural environment and wildlife habitat as possible. Going off-path is strictly prohibited.

• Footwear: The Participant understands and agrees that good, sturdy walking shoes are essential for navigating the rainforest paths safely. Flip-flops, sandals, or high heels are unsuitable for nature walks.

• Wildlife Respect: The Participant must observe all wildlife from a respectful distance. The rainforest is a habitat for various creatures, and the Participant agrees not to feed, disturb, or attempt to touch any animals or plants.

• Waste: The Participant agrees to pack out all trash and leave no trace to protect the delicate ecosystem.

• Personal Health: The Participant confirms they are in good health and have no medical conditions that would make it unsafe for them to use the thermal baths or participate in nature walks.

 Comfort and Care (Insect Management)

We want your rainforest experience to be as enjoyable as possible. While biting insects are a natural and essential part of our healthy rainforest ecosystem, we take proactive, nature-friendly steps to minimize their impact on your stay:

• Natural Deterrents: We use citronella oil in various areas of the property as a natural, non-harmful way to deter many of the flying biting pests.

• Protection Provided: For your comfort and safety during nature walks and outdoor activities, natural bug repellent has been readily provided in your accommodation. We strongly encourage its use before heading out.

• Post-Exposure Care: Should you experience any bites or stings, we have also provided Good Riddance Rescue Balm in your accommodation. Please apply this balm for soothing relief after any exposure to pests.

By signing this waiver, you acknowledge that you have been advised of these natural preventative and remedial measures and understand that encounters with insects are a possibility in this environment.

​Responsible Alcohol Consumption and Compliance

To ensure your safety while using the thermal baths and sauna, and to comply with liquor control regulations, the following rules regarding alcohol consumption must be strictly observed:

• Hamper Purchase Limit: To adhere to local liquor control laws, each couple is strictly limited to purchasing only one (1) hamper containing alcohol (one bottle total).

• Per Person Limit: This purchase is intended to supply a maximum of one to two drinks per person for responsible, moderate consumption.

• Safety Restriction: The Participant acknowledges that consuming alcohol before or during the use of the thermal baths or infrared sauna significantly increases risks, including overheating, dehydration, dizziness, and fainting.

• Waiver of Liability: The Participant understands that any consumption of alcohol is at their own risk, and they agree that the terms of the Release of Liability and Indemnity  fully apply to any injury, damage, or loss resulting from alcohol consumption.

• Compliance: We reserve the right to refuse service or ask a guest to leave the facilities if their consumption of alcohol poses a risk to their safety, the safety of others, or violates this policy.

By signing this waiver, the Participant confirms they understand and agree to comply with this responsible alcohol consumption policy and its limits.

Release of Liability and Indemnity

The Participant, on behalf of themselves and their heirs, executors, administrators, and assigns, hereby releases, discharges, and forever holds harmless Itsinya and its owners, employees,  and representatives ("Released Parties") from any and all claims, demands, actions, or causes of action arising out of any damage, injury, loss, or death sustained by the Participant while on the Property or participating in any activity, even if caused by the negligence of the Released Parties.

The Participant further agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorney's fees, that the Released Parties may incur as a result of the Participant’s presence on the Property, whether caused by the Participant’s negligence or otherwise.

Governing Law

This Waiver shall be governed by and construed in accordance with the laws of Queensland.

I have read this Guest Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by ticking the check box prior to booking to be a complete and unconditional release of all liability to the greatest extent allowed by law.
